General Terms and Conditions of Implant Prosthetic Academy (IPA)
Preamble Wolfgang Bollack, Dentaltechnik e. Kfm., Pfarrgasse 2, D 69251 Gaiberg, makes available various digital products against payment via its internet portal (IPA) by means of an access link. The rights of use acquired for the individual DocuCasts always refer to the purchaser who bought the product. Such purchaser can be a company or a natural person. The individual customer may use the products on the IPA website for an unlimited period of time. Any rights exceeding the previously specified must be negotiated separately. Any reproduction of the digital products or disclosure to third parties is prohibited and also not in the purchaser’s own interest. You should keep the knowledge you acquired and paid for to yourself in order to secure your competitive edge. The following General Terms and Conditions shall govern the legal relationship between the Customer and Wolfgang Bollack Dentaltechnik e. Kfm.- Scope of Application
2.1 Solely the following General Terms and Conditions in the version valid at the time of placing the order shall apply to the business relations between Wolfgang Bollack e. Kfm., owner: Wolfgang Bollack, Pfarrgasse 2, 69251 Gaiberg (hereinafter referred to as „Seller“) and the Customer (hereinafter referred to as „Customer“).

2.3 Consumer within the meaning of these General Terms and Conditions is any natural person who concludes a legal transaction for purposes that are predominantly outside his/her commercial activities or his/her work as a self-employed person (§ 13 BGB [German Commercial Code]).
2.4 Deviating conditions of the Customer are not recognised unless they are expressly accepted by the Seller. - Offers and Service Descriptions
The presentation of the products in the online shop does not constitute a legally binding offer, but an invitation to place an order. Service descriptions on the website of the Seller shall not represent a guarantee or warranty. We shall reserve the right to make changes and further developments.
4. Ordering Process and Conclusion of Contract
4.1 The Customer may select products from the Seller’s DocuCasts product range without any commitment and place them in a so-called shopping cart via the button “Add to Shopping Cart”. In the shopping cart, the product selection may be changed or deleted. After that, the Customer can proceed within the shopping cart via the button „Continue to checkout“ in order to complete the ordering process.
4.2 Via the button „Buy now“, the Customer submits a binding purchase order with regard to the DocuCasts in the shopping cart. Before sending the order, the Customer may change and view the data anytime and go back to the shopping cart using the browser function „Back“ or cancel the ordering process altogether. Important! Prior to the sending of the order, the Customer must read and accept the General Terms and Conditions.
4.3 The Seller then sends the Customer an automatic confirmation of receipt by e-mail, in which the Customer’s order is listed once again and which the Customer can print out via the „Print“ function (order confirmation). The automatic confirmation of receipt merely documents that the Customer’s order has been received by the Seller and does not constitute acceptance of the order. The purchase contract is only concluded when the Seller makes available the ordered product to the purchaser for download by means of an access code and when the Seller sends the order confirmation and the invoice to the purchaser by means of a second e-mail.
4.4 The products of Implant Prosthetic Academy (DocuCasts) are digital products and are provided online to the Customer. They will be activated for the Customer after receipt of payment. The order has then been completed for the purchaser and the Seller without any further consequences.
- Prices and Shipping Costs
All prices quoted on the Seller’s website are exclusive of the applicable VAT.
6. ShipmentThe DocuCasts will be activated for the Customer directly after receipt of payment.
- Terms of Payment
7.1 The Customer can choose from the available payment methods during and before the ordering process. Customers are informed about the available means of payment on a separate information page.
7.2 The third-party providers PayPal und Klarna Sofortüberweisung are charged with the handling of payments and their general terms and conditions shall therefore apply accordingly.
8. Warranty and Guarantee
8.1 The warranty is based on the statutory provisions.
8.2 The Seller guarantees that the promised content is delivered and that the data is transferred properly.
- Liability
9.1. For a liability of the Seller for damages, the following exclusions and limitations of liability shall apply without prejudice to the other statutory eligibility requirements.
9.2 The Seller shall not be liable for unsuccessful treatments by a doctor or for injury to the life, body and health of the patient caused by a doctor. The Seller shall also not be liable for injuries of a dental technician he/she sustained during the performance of his/her prosthetic work. The DocuCasts offered describe procedural methods (workflow) of a prosthetic implant treatment. They have been developed by experienced experts in the field of implantology. However, they require a high level of professional competence and qualification of the doctor, which the Seller cannot assess.
9.3 The exclusion of liability shall also apply to the personal liability of employees, representatives and vicarious agents.
- Storage of Contract
10.1 The Customer can print the contract before submitting the order to the Seller by using the print function of his/her browser in the last step of the ordering process.
10.2 The Seller shall send to the Customer an order confirmation containing all order data to the e-mail address provided by the latter. Along with the order confirmation, the Customer also receives a copy of the General Terms and Conditions together with information on the right of cancellation and the terms of payment. If you have registered in our shop, you can see your orders placed in your profile area. In addition, we save the contract, but we do not make it available online. - Right of Cancellation
11.1 The digital products of IPA are a transfer of knowledge in the B2B area. As soon as the requested access data for the download of the DocuCasts have been sent, i.e. have been made available online, a rescission of the contract is no longer possible. In such a case, the right of cancellation is excluded.
11.2 Consultancy services are generally excluded from the right of return. - Copyright

Only the corresponding purchasers are allowed to use the digital products. The purchaser is not allowed to copy and distribute the contents. The rights of use may be acquired as a license for further marketing.

- Final Provisions
13.1 Jurisdiction and place of performance is the registered office of the Seller, if the Customer is a merchant, a legal entity under public law or a special fund under public law.
